If you are the target of an allegation:

  • Do not talk to anyone without legal counsel and learn more about your Miranda Rights
  • If a serious allegation is made, contact an Administrative Law attorney if your area does not have an attorney who specializes in foster care issues. (See our Legal Assistance Page)
  • Request the policy and procedures concerning investigations for your agency. Find the Administrative Code for your state on the Internet or at your public library. (See our State Pages  and Legal References for additional references and links for your state)
  • Contact your state or local Foster Parent Association for support. Many states have an allegation support team.
  • Gather evidence for your case. Look through old daily planners, notebooks, calendars. (See our Free Publication: "Standing in the Shadow of the Law"
  • If you did nothing wrong, do not plea bargain.
  • Find out your rights for an appeal.
  • If the finding is not in your favor, fight back. Contact your Children Services director, county commissioner and legislators. Find someone who will listen to you. Like our Foster Parent Allegations Group
